It is strictly prohibited to modify, transmit, distribute, reuse, reverse engineer, repost, "frame," or use the Content without written permission from an authorized representative of The Dresser Shoppe.

WHILE THE DRESSER SHOPPE DESIRES THAT THE CONTENT AND INFORMATION ON THE SITE BE UP-TO-DATE AND ACCURATE, IT IS YOUR SOLE RESPONSIBILITY TO CONFIRM THE ACCURACY, COMPLETENESS, OR RELIABILITY OF SUCH CONTENT AND INFORMATION. THE DRESSER SHOPPE DOES NOT WARRANT OR MAKE ANY REPRESENTATION REGARDING THE USE OF THE CONTENT OR INFORMATION ON THE SITE OR THE ACCURACY OR RELIABILITY OF SUCH CONTENT OR INFORMATION.

 

Your Status

By placing an order through Our Site, you warrant that you are:

(a) legally capable of entering into binding contracts;  and (b) at least 18 years old.

Cancellation

• Order cancellations are subject to The Dresser Shoppe prior approval.

Availability and Delivery

• The Dresser Shoppe will use its best endeavours to effect delivery in the time stated (if a time is stated in writing) but if The Dresser Shoppe fails to do so by reason of:

(a) inability to obtain supplies of materials or parts from approved sources;

(b) any strike, shortage of labour or lockout;

(c) war, riots, accident, civil commotion, fire, Act of God; or

(d) any other event whatsoever beyond the reasonable control of The Dresser Shoppe

• The Dresser Shoppe may at its option cancel the Contract or any unfulfilled part or extend the time for its performance or completion by the time lost because of the event preventing or delaying delivery.

• Unless otherwise agreed in writing, The Dresser Shoppe will deliver the Products to the buyer’s premises during business hours. The invoice will be included with the package. 

• Delivery is deemed to occur when the Products are unloaded at the buyer’s premises (or other premises agreed by the parties). If the buyer fails or refuses, or indicates to The Dresser Shoppe that it will fail or refuse, to take or accept delivery, then (unless otherwise agrees) the Products will be deemed to have been delivered when The Dresser Shoppe was ready, willing and able to deliver them.

Risk and Title

• The Products will be at your risk from the time of delivery.

• Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

 

Limitation of Liability

THE DRESSER SHOPPE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, OR ANY OTHER DAMAGES WHATSOEVER THAT RESULT FROM THE USE OR PERFORMANCE OF, OR THE INABILITY TO USE, THIS SITE, THE PRODUCTS OR FUNCTIONS ON THIS SITE. YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF, RELATING TO OR IN ANY WAY CONNECTED WITH YOUR USE OF THIS SITE OR THESE TERMS OF USE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES OTHERWISE SUCH CAUSE OF ACTION SHALL BE PERMANENTLY BARRED.

IN CERTAIN STATES AND JURISDICTIONS, THE LIMITATIONS OF LIABILITY SET FORTH IN THESE TERMS AND CONDITIONS ARE NOT PERMITTED AND SO THE FOREGOING LIMITATIONS DO NOT APPLY TO YOU. TO THE EXTENT THAT THE DRESSER SHOPPE AND ITS AFFILIATES MAY NOT, AS A MATTER OF LAW, DISCLAIM ANY IMPLIED WARRANTIES OR LIMIT ITS LIABILITIES, THE SCOPE AND DURATION SHALL BE THE MINIMUM PERMITTED UNDER APPLICABLE LAW.

Warranty

(a) The manufacturer warranty terms and conditions are as detailed in the Product warranty leaflet that is supplied with the relevant products.

(b) Should you wish to report a problem with, or request warranty for, a Product please contact The Dresser Shoppe Customer Service info@DresserShoppe.com.

(c) Nothing contained in these terms and conditions excludes, restricts or modifies the application of any implied condition or warranty, the exercise of any right or remedy, or the imposition of any obligation, right or liability implied or conferred under the United State Consumer Law, or any other statute, to the extent that doing so would contravene that statute or cause any part of this these terms and conditions to be void.

(d) To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on The Dresser Shoppe are expressly excluded from these terms and conditions.

(e) To the extent that the US Consumer Law permits The Dresser Shoppe to limit its liability, then The Dresser Shoppe liability will be limited to:

(1) in the case of services, the cost of supplying the services again or payment of the cost of having the services supplied again; or

(2) in the case of goods, replacing the goods, supplying equivalent goods or having the goods repaired, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired..

Intellectual Property

The Dresser Shoppe will aggressively enforce its intellectual property rights to the full extent of the law.  All images, text, sound, photos, custom graphics, button icons, the collection and compilation and assembly thereof, and the overall “look and feel” and distinctiveness of the Site constitute trade dress and are either the property of  The Dresser Shoppe or used on this Site with permission. The absence on the Site of our name or logo does not constitute a waiver of our trademark or other intellectual property rights relating to such name or logo. All other product names, company names, marks, logos, and symbols appearing on the Site may be the trademarks and the property of their respective owners. 

You acknowledge and agree that information, and services available on the Site are protected by copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights and laws and are owned or licensed by The Dresser Shoppe
